Compliance & Regulatory Disclaimer
Last updated: July 2026
1. Introduction
This Compliance & Regulatory Disclaimer (Disclaimer) sets out the allocation of compliance responsibilities between MJQM Pty Ltd (ABN 39 694 692 003) trading as DogsWelcome (DogsWelcome, we, us, or our) and all users of the DogsWelcome platform (Platform), including property hosts (Hosts) and guests (Guests).
This Disclaimer forms part of the DogsWelcome document suite and must be read together with the Guest Terms of Service, Host Terms of Service, Community Guidelines, Privacy Policy, Refunds, Cancellations and Payout Policy, Damage & Claims Policy, Platform Fee Disclosure Statement, and Cookie Notice. The relevant Terms of Service will prevail in the event of any inconsistency.
By using the Platform, you agree to the terms of this Disclaimer. In this Disclaimer, Companion Animal means any dog brought to a Host Property by a Guest in connection with a Booking.
2. Platform Role and Verification Limitations
DogsWelcome is a technology platform operator and marketplace intermediary. It is not a government authority, compliance assessor, fire safety inspector, STRA registration body, insurance provider, or legal advisor.
While DogsWelcome uses automated tools to assist with STRA registration format checks and expiry monitoring, it does not independently verify the validity of STRA registration numbers, fire safety declarations, or other compliance information with the relevant government authority. The availability of automated checking tools does not constitute a representation that a Host's compliance information is accurate, current, or valid. Hosts remain solely responsible for the accuracy of all compliance information provided to DogsWelcome.
3. Host Compliance Responsibilities
Hosts are solely responsible for ensuring that their Host Property and use of the Platform comply with all applicable laws and regulations, including:
Hosts must ensure all compliance information provided to DogsWelcome is accurate and current. If any compliance status changes after a listing is published, the Host must promptly update their listing and notify DogsWelcome. DogsWelcome may request documentation, suspend, or remove a listing that appears non-compliant. Such action does not constitute an assumption of any compliance obligation by DogsWelcome.
4. Fire Safety Requirements
Hosts must, at all times during which their Host Property is listed or occupied under a Booking, install and maintain compliant smoke alarms and fire safety equipment, ensure fire exits and escape routes are unobstructed and functional, provide accurate fire safety declarations to DogsWelcome, display emergency evacuation information within the property, and promptly notify DogsWelcome of any change to the property's fire safety status.
DogsWelcome accepts no liability for any loss, injury, or damage arising from a Host's failure to comply with applicable fire safety requirements.
5. STRA Registration
Where STRA registration is required in the relevant jurisdiction, Hosts must obtain a valid STRA registration number before publishing a listing, maintain that registration in good standing, accurately enter it in their listing, comply with all associated conditions including night caps and occupancy limits, and promptly notify DogsWelcome if registration is suspended, cancelled, or expires.
DogsWelcome may automatically suspend or remove a listing where automated checks indicate an invalid, incorrectly formatted, or expired STRA registration number. Such suspension does not constitute a determination of non-compliance. Hosts who consider a suspension is in error should contact support@dogswelcome.co.
6. Local Council and Planning Requirements
Hosts must independently verify and comply with all local council requirements applicable to the operation of short-term rental accommodation at the Host Property, including requirements relating to permitted use and development consent, strata or body corporate by-laws, waste management, noise standards, and neighbourhood association rules.
DogsWelcome does not provide advice on local council or planning requirements and makes no representation that any listing satisfies local government requirements.
7. Guest Responsibilities
Guests must read and comply with all house rules, fire safety instructions, and emergency procedures provided by the Host or displayed at the Host Property, comply with applicable noise and behavioural requirements, not exceed the maximum occupancy stated in the listing, and satisfy themselves that the property is suitable for their needs and the needs of any Companion Animal before confirming a Booking.
DogsWelcome does not assess or warrant the suitability of any Host Property for any particular Guest or Companion Animal.
8. Accuracy of Platform Information
The Platform relies on information provided by Hosts and does not independently verify, audit, or guarantee the accuracy, currency, or completeness of any listing, compliance declaration, fire safety statement, STRA registration detail, or other information published on the Platform. To the maximum extent permitted by the ACL, DogsWelcome disclaims any warranty or guarantee as to the accuracy of Platform information. Nothing in this clause excludes any consumer guarantee that cannot lawfully be excluded under the ACL.
9. No Legal, Regulatory, or Safety Advice
All information provided by DogsWelcome through the Platform, by email, or through automated tools is general information only. It does not constitute legal, regulatory, fire safety, planning, insurance, or compliance advice and must not be relied upon as such. Users requiring advice on their legal or regulatory obligations should obtain independent advice from a qualified Australian legal practitioner.
10. Enforcement and Regulatory Cooperation
DogsWelcome may, without prior notice, suspend or remove any listing that appears non-compliant, request documentation from a Host to verify compliance, restrict or cancel associated Bookings, and cooperate with government authorities and regulators, including by disclosing information about a Host or listing, where required or permitted by law. DogsWelcome's exercise of these rights does not give rise to any liability, including for loss of revenue or Bookings suffered by a Host.
11. Limitation of Liability
To the maximum extent permitted by law, DogsWelcome excludes all liability for: any compliance failure by a Host; any fine, penalty, enforcement action, or legal consequence arising from non-compliance with applicable laws or regulations; any loss, damage, injury, or death arising from inaccurate fire safety information or non-compliant safety equipment at a Host Property; and any loss arising from the suspension or removal of a listing under clause 10. This exclusion does not apply to liability arising from DogsWelcome's own fraud or wilful misconduct.
Where liability cannot be excluded by law, including under the non-excludable consumer guarantees in the ACL, DogsWelcome's liability is limited to the re-supply of the relevant service or the cost of re-supply.
12. Amendments to this Disclaimer
DogsWelcome may amend this Disclaimer at any time. Where any amendment materially affects a User's rights or obligations, DogsWelcome will provide no less than 14 days' prior written notice by email before the amendment takes effect, except where amendment is required to address changes in applicable law or immediate safety concerns. Continued use of the Platform following the notice period constitutes acceptance of the amended Disclaimer.
13. Governing Law
This Disclaimer is governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
